Terms of Service

Last updated 17 September 2026

These Terms of Service (“Terms”) govern your access to and use of the Vlyt mobile application and website at vlyt.app (together, the “Service”), operated by Vlyt Software (Pty) Ltd (registration number 2026/823208/07) (“Vlyt,” “we,” “us”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use Vlyt.

Our Privacy notice explains how we handle personal information under POPIA.

1. The Service

Vlyt is a business-management tool for small operators, tradespeople, freelancers, and micro-businesses. Features may include a product catalog, contacts, quotes, stock, expenses, and simple reports. Features available to you may depend on your plan or release stage.

Vlyt is not accounting software, tax advice, legal advice, or a payments provider. Reports (including VAT summaries and related exports) are aids for your own record-keeping. You remain responsible for verifying accuracy and for your own regulatory and tax compliance (including SARS filings where applicable).

2. Eligibility

You must have legal capacity to enter into a binding contract. If you are under 18 (or the age of majority where you live), a parent or legal guardian must consent to your use of the Service and accept these Terms on your behalf. You must provide accurate registration information.

3. Account and security

You are responsible for keeping your login credentials and any device-level unlock (PIN, biometric) confidential, and for all activity under your account. Notify us promptly at support@vlyt.app if you suspect unauthorised access. We may suspend or terminate accounts that provide false information or violate these Terms.

4. Your business data

You retain ownership of the business data you input — including customers, quotes, products, stock, expenses, and reports. We process that data only to provide the Service, as described in our Privacy notice.

You are solely responsible for the accuracy of quotes, prices, VAT, customer details, and other business or tax data you enter. Vlyt does not verify that your quotes or records meet any customer, industry, or legal requirement.

You may export or request deletion of your data subject to legal retention requirements described in the Privacy notice.

5. Acceptable use

You agree not to:

  • Use Vlyt for any unlawful purpose, or to defraud customers or suppliers
  • Attempt to reverse-engineer, scrape, overload, or interfere with the Service
  • Upload content that is unlawful, defamatory, or infringes another party’s rights
  • Share your account credentials with unauthorised third parties
  • Misuse messaging features (including WhatsApp deep links) to send spam or unsolicited bulk messages
  • Bypass security, rate limits, or access controls

We may suspend or terminate accounts that violate this section.

6. Subscriptions and pricing

The Service may be offered free for early users. If paid plans are introduced, prices will be shown before you subscribe. Mobile subscriptions (where offered) are billed through Apple App Store / Google Play and subject to those stores’ refund and cancellation rules. Web subscriptions (where offered) are billed by our payment processor under the terms shown at checkout.

We may change prices or plan features with reasonable notice. Downgrading or cancelling may limit access to some features; your underlying business data is retained per the Privacy notice unless you delete your account.

7. Third-party services

The Service may integrate with third parties (for example Google Sign-In, SMS providers, email delivery, analytics, crash reporting, or WhatsApp). WhatsApp messages are sent through your WhatsApp account via a deep link; we do not control WhatsApp/Meta’s service or message delivery. Your use of third-party services is also subject to their own terms and privacy policies.

8. Intellectual property

The Vlyt app, website, branding, and underlying software are owned by the Operator and protected by applicable intellectual property laws. These Terms grant you only a limited, non-exclusive, non-transferable right to use the Service as intended. They do not transfer ownership of our trademarks, source code, or design.

9. Availability

We provide the Service on an “as is” and “as available” basis. Features may change. We may pause or modify the Service for maintenance, security, or operational reasons. We do not guarantee uninterrupted or error-free operation.

10. Disclaimers

To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. Nothing in these Terms excludes warranties or remedies that cannot be excluded under South African consumer protection or other mandatory law.

11. Limitation of liability

To the maximum extent permitted by South African law, Vlyt and the Operator shall not be liable for indirect, incidental, special, or consequential damages, including loss of profits, business opportunity, goodwill, or data, arising from your use of or inability to use the Service.

Where liability cannot be excluded, our aggregate liability arising out of these Terms or the Service is limited to the greater of (a) the amounts you paid us for the Service in the twelve (12) months before the claim, or (b) ZAR 1,000 — except that nothing limits liability for gross negligence, wilful misconduct, or other liability that cannot be limited by law.

12. Indemnity

You agree to indemnify and hold harmless the Operator from claims, damages, and expenses (including reasonable legal fees) arising from your misuse of the Service, your business data or quotes, your violation of these Terms, or your violation of any law or third-party right — except to the extent caused by our gross negligence or wilful misconduct.

13. Termination

You may stop using Vlyt and delete your account at any time via in-app settings (when available) or by contacting support@vlyt.app. We may suspend or terminate access if you materially breach these Terms, with notice where reasonably practicable. Provisions that by nature should survive (including ownership, disclaimers, liability limits, and governing law) survive termination.

14. Governing law and disputes

These Terms are governed by the laws of the Republic of South Africa, without regard to conflict-of-law rules. Try to resolve disputes informally by contacting support@vlyt.app first. If that fails, disputes are subject to the jurisdiction of the South African courts, without prejudice to any non-waivable consumer rights you may have where you live.

15. Changes

We may update these Terms from time to time. The “Last updated” date above shows the current version. Material changes will be noted on this page and, where appropriate, in the app or by email. Continued use after the effective date constitutes acceptance of the updated Terms.
